Career Opts, LLC
This agreement is made and entered into effect by and between Career Opts, LLC, its successors and assigns (hereinafter "Career Opts") and you whose current mailing address is entered in the application.
WHEREAS, Career Opts is engaged in the business of providing educational and training related services; and
WHEREAS, you wish to learn from such services in one of various ways such as taking a course offered;
NOW, THEREFORE, in consideration of the promises and the mutual covenants and provisions hereinafter set forth, the parties do hereby agree as follows:
Course - Any course, seminar, webinar, slidecast, etc. offered by Career Opts
Traditional Classroom – A course taken in a physical classroom with the instructor teaching in a face-to-face setting.
Virtual Classroom – A course taken using a web-conferencing software with live interaction between instructors and participants.
Online Course – A course with no live interaction with an instructor. All course material is available through an online Learning Management Software (LMS).
Participant – Anyone attending any of the courses offered by Career Opts.
If you are not 100% satisfied with any of our courses within the first ten percent duration of a Traditional Classroom or Virtual Classroom course, or within ten percent of viewing online material and ten percent of time duration of an Online Course, you may retake the course at no charge or apply paid tuition fees against another course. If you are not satisfied with the course, you must return all course material and any accompanying materials back to Career Opts at your expense within seven days of your decision, before re-taking the course or taking another course.
If you pay full price to attend any of our courses, attend the class, and pass our internal exam, we would continue to offer you the same course (or a Traditional Classroom course, a Virtual Classroom course, or Online Course as replacement) until you pass the corresponding third-party exam as long as you continue to attempt the exam within thirty days of taking the course.
If you pay full price to utilize our Resume Service, we would continue to improve your resume until you are 100% satisfied with the results, or you do not contact us within thirty days of our last correspondence - at which point we assume that you are 100% satisfied with our service.
You may upgrade from an Online Course to either a corresponding Virtual Classroom or Traditional Class. 100% of the tuition paid by you towards the Online Course would be applied towards the tuiton of the Virtual Classroom or Traditional Class.
You may assign someone else to take any Traditional Class or Virtual Classroom in your place, provided that you notify us of your decision in writing before the first day of the course. All of the tuition paid for your attendance would apply to the tuition fee of the subsitute participant. Career Opts would not charge any additional fee for such a substitution. However, no discounts that may have applied to you would apply to the substitute.
There is no charge to cancel your registration if you do so in writing fifteen days prior to the course start date. If you cancel your registration within two weeks of course start date, there would be a $3,000 cancellation fee.
At times, we must change a course location, course date, or postpone a course. Career Opts will try to give you as much advance notice as possible of any such change. If you are unable to attend a course at the revised location or date, Career Opts will credit 100% of any course tuition fees against a future course or, if requested, refund those fees. However, we will not be liable for any other costs incurred, including, but not limited to, travel charges or any consequential damages even if we were advised of them.
All copyrights, patents, designs, trademarks, logos, and other intellectual property rights in or relating to any course material provided or made available in connection with our courses remain property of Career Opts, or any other third party that owns the intellectual property. No part of any course material may be reproduced, stored in a retrieval system, or transmitted in any form by any means, electronic mechanical, photocopying, recording, or otherwise, or translated into any language, without prior written permission of Career Opts.
Invalidity of Provisions. In the event that any provisions or portion of a provision of this Agreement shall be held to be unreasonable or unenforceable by reason of the geographic or business scope or the duration thereof, or for any other reason, then in such even, such provisions or portion thereof shall nevertheless be effective and enforceable to the extent determined reasonable. Such unenforceability, and in all other respects such provisions or portion thereof shall be deemed enforceable, it being the intention of the parties that this Agreement be construed in all respects as if such invalid or unenforceable provision were omitted therefrom.
Applicable Law. This Agreement and the rights of the parties hereunder shall be governed by the laws of the Commonwealth of Virginia. The parties agree that any dispute arising pursuant to this Agreement shall be resolved in the Courts of the Commonwealth of Virginia in the County of Fairfax.
Notices. Any notice or other communication required or permitted to be given to a party pursuant to this Agreement shall be in writing and shall be either delivered personally or sent by United States certified or registered mail, return receipt requested, postage prepaid to the address provided to by you to Career Opts and if to Career Opts, then address advertised by Career Opts.
Agreement Modifications. Career Opts reserves the right to modify this agreement from time to time with or without notice. You accept publication of the new agreement on the website of Career Opts to be sufficient notice. Your continued registration of courses from Career Opts is accepted as complete agreement to the new Agreement by the you. You may wish to re-read the Agreement before registering for any courses from the website of Career Opts.
Attorneys’ Fees. In the event that Career Opts must take any legal action to enforce any term of this Agreement, You agree to reimburse Career Opts for all costs, including but not limited to reasonable attorney’s fees.
Policies and Procedures. You agree to conform to the rules, regulations, policies, and procedures of Career Opts at all times.
Career Opts reserves the right to refuse course offering to anyone, cancel a course, or postpone a course at its sole descretion.
IN WITNESS WHEREOF, you agree to this agreement, effective the date and time of application submitted.
